§ 1. General Provisions and Seller Details

  1. The online store operating at https://beeboxes.eu (the “Store”) is run by:

  2. These Terms set out the rules for concluding sales contracts via the Store and the rights and obligations of the Seller and the Buyer.

  3. The Store delivers to Poland and to the European Union member states listed in the cart (in particular Germany). Available delivery countries and shipping costs are shown in the cart before the order is placed.

§ 2. Definitions

  1. Consumer — a natural person entering into a legal transaction with the Seller that is not directly related to their trade or profession.
  2. Entrepreneur with consumer rights — a natural person concluding a contract directly related to their business activity, where the contract is not of a professional nature for them (a concept of Polish law).
  3. Buyer — any person or entity making purchases in the Store.
  4. Goods — products available in the Store, in particular beehives, hive components and beekeeping accessories.

§ 3. Placing Orders

  1. Orders may be placed via the Store’s website 24/7.
  2. To place an order, the Buyer adds Goods to the cart, provides the data required to process the order, selects the delivery and payment method, and confirms the order using the “Buy and pay” (order with obligation to pay) button.
  3. Placing an order constitutes an offer to conclude a sales contract. The contract is concluded when the Seller confirms acceptance of the order for processing (by e-mail).
  4. No customer account is required to place an order.

§ 4. Prices and Payment

  1. All prices in the Store are gross prices (including VAT) and are expressed in Polish złoty (PLN).
  2. The price of the Goods does not include delivery costs, which are indicated in the cart before the order is placed.
  3. Available payment methods:
    cash on delivery — payment to the courier upon receipt (where available for the delivery country),
    bank transfer to the Seller’s account:

  4. For prepaid orders, processing begins once payment is credited. If payment is not received within 7 days, the order may be cancelled.

§ 5. Delivery

  1. Delivery is available in Poland and to the EU countries listed in the cart. International delivery costs depend on the country and the size of the Goods and are shown in the cart before the order is placed.
  2. Delivery methods:
    – courier shipment (cost visible in the cart),
    personal collection from the Seller’s warehouse: ul. Tunkla 129, 41-707 Ruda Śląska, Poland — free of charge, by prior appointment via phone or e-mail.
  3. The order processing time is up to 10 business days from the conclusion of the contract (for prepayment — from the crediting of payment), unless a different time is stated on the product page. Goods marked as “available to order” are manufactured after the order is placed — the lead time is stated on the product page or confirmed individually. For deliveries outside Poland, the delivery time is extended by the international transit time (usually 2–5 business days).
  4. The Buyer should, where possible, inspect the parcel upon receipt. A damage report drawn up with the courier facilitates complaint handling but is not a precondition for it.

§ 6. Right of Withdrawal

  1. A Consumer or an Entrepreneur with consumer rights may withdraw from a distance contract within 14 days of the day on which they, or a third party indicated by them (other than the carrier), took possession of the Goods — without giving any reason.
  2. To withdraw, a statement must be submitted to the Seller — e.g. by e-mail to biuro@beeboxes.eu or in writing to the warehouse address (ul. Tunkla 129, 41-707 Ruda Śląska, Poland). The model withdrawal form (Annex 1) may be used but is not obligatory. Sending the statement before the deadline expires is sufficient to meet it.
  3. The returned Goods must be sent back to the warehouse address: AG Partner Adam Gawroński — Beeboxes, ul. Tunkla 129, 41-707 Ruda Śląska, Poland (not to the registered office), without undue delay and no later than 14 days from submitting the withdrawal statement.
  4. The Seller shall refund all payments received, including delivery costs (except additional costs resulting from choosing a delivery method other than the cheapest standard option offered), without undue delay and no later than within 14 days of receiving the withdrawal statement. The Seller may withhold the refund until the Goods are received back or proof of their return is provided.
  5. The direct cost of returning the Goods is borne by the Buyer. Due to the dimensions of some Goods (hives, hive bodies), the estimated cost of a courier return from abroad is approx. EUR 15–40.
  6. The Buyer is liable for any diminished value of the Goods resulting from handling beyond what is necessary to establish their nature, characteristics and functioning.
  7. The right of withdrawal does not apply, among others, to contracts for non-prefabricated Goods manufactured to the Buyer’s specifications or clearly personalised (e.g. hives made to custom dimensions). This is indicated on the product page before the order is placed.

§ 7. Complaints (Non-conformity of the Goods with the Contract)

  1. The Seller is obliged to deliver Goods that conform to the contract and is liable to Consumers and Entrepreneurs with consumer rights for any lack of conformity under applicable consumer protection law (implementing Directive (EU) 2019/771).
  2. The Seller is liable for non-conformity existing at the time of delivery and revealed within 2 years of delivery.
  3. Complaints may be submitted by e-mail to biuro@beeboxes.eu or in writing to the warehouse address: ul. Tunkla 129, 41-707 Ruda Śląska, Poland. A complaint should include: the Buyer’s details, order number or proof of purchase, a description of the non-conformity and the request (repair or replacement; in cases provided for by law — price reduction or withdrawal from the contract).
  4. Where necessary for the complaint to be examined, the Goods should be delivered to the warehouse address. The cost of delivering the complained-about Goods is borne by the Seller.
  5. The Seller shall respond to a complaint within 14 days of its receipt. No response within this period means the complaint has been accepted.
  6. For Buyers who are neither Consumers nor Entrepreneurs with consumer rights, the Seller’s statutory warranty liability is excluded.
  7. Any manufacturer’s guarantee is independent of the statutory rights arising from non-conformity of the Goods with the contract.

§ 8. Out-of-court Dispute Resolution

  1. Consumers may use out-of-court complaint and redress procedures, including permanent consumer arbitration courts at the Polish Trade Inspection and the assistance of consumer organisations. Details: https://uokik.gov.pl.
  2. Consumers residing in other EU countries may also contact their national consumer protection bodies or the European Consumer Centres Network (ECC-Net).
  3. Participation in out-of-court procedures is voluntary for both parties.

§ 9. Personal Data

The controller of Buyers’ personal data is the Seller. Details of data processing and cookies are set out in the Privacy Policy: https://beeboxes.eu/polityka-prywatnosci/.

§ 10. Final Provisions

  1. Contracts are concluded in Polish, German or English and are governed by Polish law.
  2. This choice of law does not deprive Consumers habitually resident in another EU member state of the protection afforded by mandatory provisions of the law of that state (Art. 6(2) of the Rome I Regulation). Nothing in these Terms excludes or limits mandatory consumer rights; in the event of a conflict, statutory provisions prevail.
  3. The Seller may amend these Terms for important reasons (changes in law, changes to payment or delivery methods). Orders placed before an amendment are governed by the version in force at the time the order was placed.
  4. In matters not regulated herein, the relevant provisions of Polish law apply, in particular the Civil Code and the Consumer Rights Act.
